Last week, we explained just how helpful and necessary the Funeral Rule is. If you missed it, you can click here for the article. And it does overall help consumers greatly. But every rule must have exceptions. On some issues, it allows states to restrict certain rights. One example of this is that according to the national Funeral Consumers Alliance, both New Jersey and New York require working with a licensed funeral home whenever there is a body. Nine US states in total require this, while the other 41 do not. This means that you can never legally do the entire after death process yourself. And it’s not feasible to just move the body to another nearby state like Pennsylvania, because a funeral director is required to move the body because it requires embalming or refrigeration. The only exception to this rule is if you cremate the body first, but that too requires a funeral director.

One question based on all this is, how much do I really have to buy or work with funeral homes to stay compliant with the law? And there are some things you do have to do, and others you can choose to do yourself. Most funeral directors will charge you a flat fee for any work at all, usually called basic expenses. This is included in the list price. This varies, but generally includes things like the funeral ceremony, the legal stuff like death certificates, and being an intermediary with other organizations like cemeteries and cremation services. It is completely legal under the Funeral Rule to only choose basic services and handle the rest yourself. The funeral director cannot legally tell you otherwise. To be clear, this is not an endorsement of one option over any other because everyone’s preferences, culture, and budget will determine the best option for them.
